6) Liability
LITHOS accepts no liability for any damages arising from the use of purchased products, especially in cases of improper use. Claims for damages arising from torts are excluded. Separate liability regulations apply to international distributors, as agreed individually.
7) Warranty
The statutory warranty is valid for 2 years from delivery. Complaints must be accompanied by proof of purchase, such as an invoice, and the item must be sent or brought to LITHOS in person. The warranty does not cover normal wear and tear or usage-related damage. The warranty becomes void if the customer alters the delivered goods or uses them improperly. During the warranty period, LITHOS has the right to free repair. Partial or full replacement of the item is also permitted. If defects are not resolved within a reasonable period, the buyer is entitled to a reduction in price or withdrawal from the contract.
8) Retention of Title
The goods remain the property of LITHOS until full payment has been made. For international orders, the goods remain the property of LITHOS until all costs have been fully settled, including any long-term payment agreements.
9) Intellectual Property
LITHOS retains all rights to all designs, texts, and graphics on its websites. Copying or other reproductions of the entire website or parts thereof is permitted only for the purpose of placing an order with LITHOS. The name LITHOS, all page headers, navigation bars, graphics, and button icons are registered trademarks, trade marks, or protective marks of LITHOS. All other trademarks, product names, or company names/logos cited on this website are the sole property of their respective owners. LITHOS retains ownership and copyright to illustrations, drawings, calculations, experimental data, and other materials. Customers must obtain LITHOS's explicit written consent before passing them on to third parties. If parts of the content belong to other copyright holders than LITHOS, they will be separately marked and indicated.
10) Data Protection
LITHOS assures compliance with the Austrian Data Protection Act and other applicable legal provisions when collecting, processing, and using personal data. Customer data collected during order processing is used solely for internal market research purposes. Data is only shared with third-party partner companies to the extent necessary for proper service provision (order processing). The customer consents to this use of their data. Additionally, the customer has the right to view the data stored about them and to prohibit its use for internal market research purposes at any time upon request.
11) Jurisdiction and Applicable Law
The place of jurisdiction shall be the registered office of LITHOS. The legal relationship shall be governed by Austrian law. For international distributors the UN Convention on Contracts for the International Sale of Goods (CISG) may also apply, insofar as this has been expressly agreed. The contracting parties agree to the application of Austrian law Law.
